Companies like The Diigitals market virtual supermodels and, since 2023, brands like Mango and Levi&#8217;s have produced campaigns generated entirely by AI. H&amp;M plans to create <strong data-start=\"10027\" data-end=\"10051\">30 digital clones<\/strong> of models and allow them to license their avatars to other brands. This approach, hailed for its ethical dimension, raises a number of questions: how should exploitation rights be managed? How should creation and distribution be remunerated? What uses should be prohibited or restricted?     <\/p>\n<h3 data-start=\"10412\" data-end=\"10450\">Existing legal obligations<\/h3>\n<p data-start=\"10452\" data-end=\"11460\">Legal experts already have several references. In the United States, the <strong data-start=\"10524\" data-end=\"10553\">Fashion Workers Act (FWA<\/strong> ), which came into force in New York in June 2025, requires that any agreement relating to a digital replica <strong>(Digital Twins)<\/strong> be distinct from the representation contract, specifying scope, purpose, remuneration and duration. The FWA prohibits agencies from requiring an exclusive commitment of more than three years, or from charging more than 20% commission. The New York law also requires the client to obtain clear written consent to create or use a <strong data-start=\"11082\" data-end=\"11104\">digital replica<\/strong>, specifying the purpose, remuneration and duration. The OnLabor article stresses that this consent must be independent of the agency contract, and that clients could, on the other hand, exert pressure to work only with models who have agreed to the duplication.    <\/p>\n<p data-start=\"11462\" data-end=\"12439\">In California, two laws (AB 1836 and AB 2602) that took effect on January 1\u1d49\u02b3, 2025 strengthen protections. AB 1836 prohibits the use of <strong data-start=\"11609\" data-end=\"11655\">digital replicas of deceased persons<\/strong> without the consent of their estates and extends the right to a remedy allowing minimum damages of $10,000. AB 2602 renders <strong data-start=\"11850\" data-end=\"11867\">unenforceable<\/strong> contractual clauses authorizing the use of a digital replica without precise description or legal representation of the talent. These provisions are in addition to European regulations: the AI Act requires all AI-generated content to be clearly marked and training data to be transparent (source cited in English version not provided here), while the General Data Protection Regulation (GDPR) frames the use of biometric data.   <\/p>\n<h3 data-start=\"12441\" data-end=\"12484\">Ten recommended contract clauses<\/h3>\n<p data-start=\"12486\" data-end=\"12595\">To ensure the security of models and talents, contracts must include precise and respectful clauses:<\/p>\n<ol data-start=\"12597\" data-end=\"14912\">\n<li data-start=\"12597\" data-end=\"12894\">\n<p data-start=\"12600\" data-end=\"12894\"><strong data-start=\"12600\" data-end=\"12639\">Definition of digital replica<\/strong>: specify that it is a computer-generated representation capable of reproducing the voice, face or body of an individual. Exclude minor and standard retouching. <\/p>\n<\/li>\n<li data-start=\"12895\" data-end=\"13107\">\n<p data-start=\"12898\" data-end=\"13107\"><strong data-start=\"12898\" data-end=\"12919\">Purpose<\/strong>: detail the intended use (advertising campaign for fashion, cosmetics, perfume, watches or jewelry, e-commerce presentation, in-house training) and prohibit any unintended use.<\/p>\n<\/li>\n<li data-start=\"13108\" data-end=\"13312\">\n<p data-start=\"13111\" data-end=\"13312\"><strong data-start=\"13111\" data-end=\"13142\">Separate written consent<\/strong>: require the talent to sign a separate document specifying the creation and use of the replica, in compliance with the FWA.<\/p>\n<\/li>\n<li data-start=\"13313\" data-end=\"13484\">\n<p data-start=\"13316\" data-end=\"13484\"><strong data-start=\"13316\" data-end=\"13353\">Duration and scope of use<\/strong>: set the duration (e.g. maximum three years) and territories (worldwide or specific zones) of the clone&#8217;s use.<\/p>\n<\/li>\n<li data-start=\"13485\" data-end=\"13680\">\n<p data-start=\"13488\" data-end=\"13680\"><strong data-start=\"13488\" data-end=\"13515\">Staggered remuneration<\/strong>: set a <strong data-start=\"13529\" data-end=\"13557\">fixed fee for the creation of<\/strong> the digital twin, then <strong data-start=\"13587\" data-end=\"13609\">pay per use<\/strong> (per campaign, per video, per platform) to align interests.<\/p>\n<\/li>\n<li data-start=\"13681\" data-end=\"13887\">\n<p data-start=\"13684\" data-end=\"13887\"><strong data-start=\"13684\" data-end=\"13720\">Protection against re-training<\/strong>: prohibit the training of AI models on talent data without consent, along the lines of Californian laws.<\/p>\n<\/li>\n<li data-start=\"13888\" data-end=\"14167\">\n<p data-start=\"13891\" data-end=\"14167\"><strong data-start=\"13891\" data-end=\"13933\">Prohibition of sensitive uses<\/strong>: explicitly exclude uses that could damage reputation (non-consensual nudity, political use, misleading deepfakes). FWA already requires compliance with decency laws. <\/p>\n<\/li>\n<li data-start=\"14168\" data-end=\"14356\">\n<p data-start=\"14171\" data-end=\"14356\"><strong data-start=\"14171\" data-end=\"14205\">Revocation and right of withdrawal<\/strong>: enable talent to withdraw consent and demand the removal of generated content within a reasonable timeframe, with fair compensation.<\/p>\n<\/li>\n<li data-start=\"14357\" data-end=\"14630\">\n<p data-start=\"14360\" data-end=\"14630\"><strong data-start=\"14360\" data-end=\"14391\">Transparency and traceability<\/strong>: require the brand to document the use of the clone (dates, campaigns, platforms) and provide reports to the talent. California regulations require a specific description of usage. <\/p>\n<\/li>\n<li data-start=\"14631\" data-end=\"14912\">\n<p data-start=\"14635\" data-end=\"14912\"><strong data-start=\"14635\" data-end=\"14665\">Indemnity and insurance<\/strong>: include an indemnity clause to cover damage caused by unauthorized use, and require customers to take out liability insurance for the use of digital replicas.<\/p>\n<\/li>\n<\/ol>\n<h3 data-start=\"14914\" data-end=\"14935\">Preparing for the future<\/h3>\n<p data-start=\"14937\" data-end=\"15689\">These clauses should be included in <strong data-start=\"14981\" data-end=\"14995\">deal memos<\/strong> and framework contracts. Fashion agencies can use <strong data-start=\"15064\" data-end=\"15087\">model contracts<\/strong> and <strong data-start=\"15094\" data-end=\"15122\">negotiation playbooks<\/strong> to guide their sales teams. The aim is to protect talent while providing fashion, cosmetics, perfume, watch and jewelry houses with a clear framework for exploiting AI responsibly. Ongoing dialogue between lawyers, bookers and customers is essential: a misunderstood clause can provoke disputes or compromise trust.
