A <strong data-start=\"21251\" data-end=\"21281\">responsible use charter<\/strong> will help define clear guidelines for luxury houses and the Elite agency. It must be based on regulations (FWA, Californian laws, AI Act) and on consumers&#8217; ethical expectations. The implementation of a charter reinforces Elite&#8217;s credibility as an &#8220;open, structured and responsible&#8221; player.   <\/p>\n<h3 data-start=\"21616\" data-end=\"21653\">Regulatory and ethical overview<\/h3>\n<p data-start=\"21655\" data-end=\"22465\">The<strong data-start=\"21657\" data-end=\"21676\">European AI Act<\/strong> requires all AI-generated content to be clearly identified and the data used for training to be transparent. California laws prohibit clauses authorizing digital replicas without consent. The FWA requires separate, detailed consent for the creation of clones. In the US, federal bills such as the <strong data-start=\"22159\" data-end=\"22175\">NO FAKES Act<\/strong> aim to extend these protections nationwide. The RGPD and the &#8220;Copyright&#8221; directive already impose respect for personal data and neighboring rights. Finally, new ISO standards on AI governance will see the light of day by 2027. Elite must anticipate these developments.      <\/p>\n<h3 data-start=\"22467\" data-end=\"22526\">Matrix of uses: acceptable, conditional, prohibited<\/h3>\n<p data-start=\"22528\" data-end=\"22645\">To guide its customers, Elite can set up a <strong data-start=\"22584\" data-end=\"22595\">matrix<\/strong> that classifies practices according to three categories:<\/p>\n<ul data-start=\"22647\" data-end=\"23876\">\n<li data-start=\"22647\" data-end=\"23033\">\n<p data-start=\"22649\" data-end=\"23033\"><strong data-start=\"22649\" data-end=\"22679\">Conditionally acceptable<\/strong>: light cosmetic retouching, amplification of diversity (variations in skin color, size) when transparency is ensured. Generation of additional images from a physical shoot to feed product pages. Use of avatars for e-commerce catalogs when the model has consented and the avatar is identified.  <\/p>\n<\/li>\n<li data-start=\"23034\" data-end=\"23435\">\n<p data-start=\"23036\" data-end=\"23435\"><strong data-start=\"23036\" data-end=\"23052\">Conditional<\/strong>: transformation of gestures or faces to simulate emotions that have not been experienced, changes to the decor that could mislead the consumer (for example, showing a watch underwater when it is not waterproof). Use of avatars in sensitive contexts such as charity or political campaigns: requires the explicit agreement of the talent and the broadcaster. <\/p>\n<\/li>\n<li data-start=\"23436\" data-end=\"23876\">\n<p data-start=\"23438\" data-end=\"23876\"><strong data-start=\"23438\" data-end=\"23450\">Prohibited<\/strong>: creation of nudity or sexualized content without consent, political exploitation of avatars, misleading deepfakes. Abusive identity transformation (change of ethnicity, gender) or unauthorized AI training on the model&#8217;s image. These practices violate not only ethics but also California and New York law.  <\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"23878\" data-end=\"23915\">Internal processes and governance<\/h3>\n<p data-start=\"23917\" data-end=\"23999\">To implement this matrix, Elite will have to set up internal processes:<\/p>\n<ol data-start=\"24001\" data-end=\"25174\">\n<li data-start=\"24001\" data-end=\"24228\">\n<p data-start=\"24004\" data-end=\"24228\"><strong data-start=\"24004\" data-end=\"24028\">Informed consent<\/strong>: each talent must sign a detailed form for each project, specifying AI usage, duration and remuneration. Consent must be renewed for any extension of the campaign. <\/p>\n<\/li>\n<li data-start=\"24229\" data-end=\"24409\">\n<p data-start=\"24232\" data-end=\"24409\"><strong data-start=\"24232\" data-end=\"24261\">Prompt documentation<\/strong>: record the instructions given to generative models in order to trace the origin of images and prove that prohibited uses are avoided.<\/p>\n<\/li>\n<li data-start=\"24410\" data-end=\"24661\">\n<p data-start=\"24413\" data-end=\"24661\"><strong data-start=\"24413\" data-end=\"24433\">Ethics committee<\/strong>: regularly bring together representatives of bookers, lawyers, artists and data scientists to validate or reject certain projects. This committee could draw inspiration from Palmer IA&#8217;s governance practices. <\/p>\n<\/li>\n<li data-start=\"24662\" data-end=\"24975\">\n<p data-start=\"24665\" data-end=\"24975\"><strong data-start=\"24665\" data-end=\"24700\">Regular auditing of suppliers<\/strong>: check that AI providers comply with transparency, archiving and provenance standards, in line with AI Act obligations. For example, California requires &#8220;provenance disclosure&#8221; for generated content. <\/p>\n<\/li>\n<li data-start=\"24976\" data-end=\"25174\">\n<p data-start=\"24979\" data-end=\"25174\"><strong data-start=\"24979\" data-end=\"25009\">Transparent communication<\/strong>: informing the public when images or videos are generated by AI. Luxury consumers value authenticity; transparency reinforces trust. <\/p>\n<\/li>\n<\/ol>\n<h3 data-start=\"25176\" data-end=\"25221\">Crisis management and feedback<\/h3>\n<p data-start=\"25223\" data-end=\"25971\">Controversies surrounding AI-generated campaigns, such as Valentino&#8217;s &#8220;cheap&#8221; campaign, show that a lack of transparency can be detrimental to a brand. Elite can draw up a <strong data-start=\"25443\" data-end=\"25471\">crisis management plan<\/strong>: rapid communication, explanation of intentions, reminder of the charter. In addition, an <strong data-start=\"25558\" data-end=\"25575\">active watch<\/strong> must be organized to identify new practices (e.g. video generative AI still limited, distortions when models move) and adapt the charter.
